Terms and Conditions – Getz Hire


1. Definitions

In these Terms and Conditions:

  • “Client” refers to the person or entity hiring equipment and/or services from Getz Hire.
  • “Owner” refers to Getz Hire, the supplier and legal owner of the equipment.
  • “Equipment” includes all items hired by the Client, whether collected or delivered, regardless of payment status. All Equipment remains the property of the Owner at all times.

2. Disclaimer

The Client accepts full responsibility for the use and handling of the Equipment and agrees to release, indemnify, and hold harmless the Owner from any liability, claims, actions, demands, damages, losses, or expenses, including injury or death, arising from the use or misuse of the Equipment by the Client or any third party.

Getz Hire is not liable for any viruses, malware, cookies, or other digital issues encountered while accessing its website. Website usage is at the Client’s own risk.

All content (images, text, and graphics) is the intellectual property of Getz Hire and may not be copied, reproduced, or used for commercial or marketing purposes without prior written consent. Breach of this clause may result in legal action.


3. Hire Conditions & Client Obligations

a. General Responsibilities

The Client:

  • Acknowledges receipt of Equipment in good working condition.
  • Agrees not to alter, damage, or attach items to Equipment.
  • Must notify the Owner of lost, stolen, or damaged items immediately.
  • Is liable for the full replacement cost of any Equipment lost or returned in an unrehireable condition.
  • Must return all Equipment clean and dry, or incur a cleaning fee (linen excepted – see clause 3b).

b. Linen Conditions

  • Linen is professionally laundered, but minor creasing or imperfections may occur. These do not constitute grounds for refunds.
  • Linen returned with permanent damage (e.g. burns, holes, wax, dye, mould, graffiti, etc.) will be charged at full replacement cost.
  • Excessively soiled linen requiring special treatment will incur additional cleaning fees.
  • Linen must be returned dry. Damp items, particularly those exposed to alcohol, must not be sealed in plastic bags due to mould risk.
  • Late returns incur daily hire fees.

c. Delivery, Collection & Handling

  • Equipment must be checked by the Client upon delivery or collection. Once accepted, the Owner disclaims liability for suitability or operation.
  • Clients collecting Equipment must provide suitable transport and packaging. Getz Hire staff will not load/unload vehicles.
  • If Equipment is faulty on delivery, the Client must report issues within 6 hours. Failure to do so voids refund eligibility.
  • In the event of a fault during use, the Client must stop using the item immediately and notify the Owner.
  • Equipment must remain at the delivery location and must not be sub-hired or relocated without written consent.
  • Return items must be repacked properly. Equipment must be readily accessible for collection, or a re-collection fee will apply.
  • Setup services are not included unless expressly agreed and quoted in writing.
  • The Client is responsible for notifying the Owner of any underground hazards before pegging Equipment.
  • The Owner is not liable for property damage arising from setup, delivery, or collection, despite reasonable care being taken.

d. Access to Equipment

  • Title and ownership remain with the Owner. The Client acts only as a bailee.
  • The Owner may inspect Equipment at any time and must be granted access.
  • The Owner may terminate the hire and reclaim Equipment at any time. If access is denied, legal authorities may be engaged, and the Equipment may be considered stolen.
  • The Client indemnifies the Owner against any damage arising from such recovery efforts.

4. Payment, Refunds & Cancellations

a. Cancellations

  • Cancellations within 7 business days of the scheduled delivery incur full hire charges or agreed non-refundable deposits.
  • Cancellations within 24 hours of delivery are charged at the full rate plus delivery and packing costs.
  • Order changes within 12 hours of delivery may only involve additions.

b. Bonds & Refunds

  • A refundable bond may be required before hire commences.
  • Bonds may be paid via cash, card, or EFT. Credit card details may be held securely for damage security.
  • Any losses or damages will be deducted from the bond or charged additionally if the bond is insufficient.
  • Non-refundable bonds may apply to certain custom, installed, or sub-hired items.
  • Refunds, where applicable, may be provided as a direct payment or future hire credit.

c. Payment Terms

  • Full payment is due prior to delivery unless otherwise agreed in writing.
  • Delivery does not include setup or pack-down unless specified.
  • Hire charges apply per calendar day or per event, with extensions at the Owner’s discretion.
  • Accepted payment methods include EFTPOS, credit/debit card, bank transfer, or cheque (by agreement).
  • The Client authorises the Owner to charge their credit card for losses, damages, or outstanding fees.
  • Payments for outstanding balances are due within 7 days of invoice unless otherwise arranged.

d. COVID-19 Conditions

In the event of COVID-19-related government restrictions:

  • A full refund or credit will be offered for Equipment not yet delivered or collected (less non-refundable items).
  • If Equipment has been delivered but unused, a delivery fee and a labour surcharge (50%) apply.
  • Used Equipment will incur full hire charges.
  • Where Equipment has been setup by the Owner, full charges apply for hire, labour, and logistics.
  • Clients may reschedule their event and retain credit. Storage of items pending the new date may be offered at the Owner’s discretion.

e. Booking Deposit

A booking deposit is required to secure your event date and reserve specific Equipment or services. This deposit is strictly non-refundable under any circumstances, including change of mind or event cancellation, as it covers administrative, planning, and holding costs incurred by the Owner.

If the Client needs to postpone the event, the Owner may, at its sole discretion, allow the deposit to be transferred to a new date, subject to availability. A transfer of booking is only valid once and must be confirmed in writing. If the new date is not available or the Client cancels again, the original deposit will be forfeited.


5. Privacy & Confidentiality

Getz Hire respects your privacy. All collected personal information is stored securely and used solely for business purposes. Information is not sold or shared unless required by law. This includes data collected via phone, email, website, or in-person.

6. Force Majeure

The Owner is not liable for delays or non-performance caused by factors beyond its control (e.g., weather, strikes, civil unrest, government restrictions, or war). In such cases, obligations are suspended for the duration of the event, and no damages will be payable.


7. Acceptance of Terms

By accessing the website or taking possession of Equipment, the Client acknowledges and agrees to these Terms and Conditions. Terms may be updated without notice and are effective immediately upon publication.


8. Damage Waiver

A damage waiver may be charged to cover accidental damage to Equipment up to 7.5% of the item’s hire cost. If damage exceeds this amount, the Client is liable for the full replacement value.

The waiver does not cover:

  • Misuse or negligence;
  • Loss or disappearance of Equipment;
  • Contravention of Terms;
  • Damage from unknown causes.

The damage waiver is non-refundable.
